As part of the Hamburg Climate Plan, the Hanseatic city has set itself the goal of being climate-neutral by 2050. To this end, CO2 emissions are to be reduced by 55 percent by 2030. The Hamburg Climate Protection Act, which came into force on February 20, 2020, created a binding legal framework for this, anchoring the goals of the climate plan in law.

From this, certain obligations are derived for the citizens of the Hanseatic City with regard to renewable energies, which are specified by the Senate in implementation ordinances.

Thus, as of January 1, 2021, a new implementation regulation for heating systems or heat generation, the so-called Renewable Energy Obligation (RE Obligation), applies. According to § 17 paragraph 1 HmbKliSchG, homeowners will be obliged to cover at least 15% of the heat energy demand with renewable energies from 01.07.2021 when replacing or retrofitting a heating system in a building that was constructed before 1 January 2009.

According to § 6 paragraph 1 HmbKliSchUmsVO,”solar radiation energy, environmental heat, geothermal energy, solid, liquid and gaseous biomass, which are used without previous conversion into electrical energy for the purpose of heat utilization” are recognized as renewable energies.Under special conditions or in individual cases, the obligation to use renewable energies may be waived or fulfilled by substitute measures.

It is therefore not sufficient if the order for the heating system replacement is received by the heating installer before 30.06.2021.
